SPANISH SUPREME COURT CONDEMNS COMPANIES THAT COMMERCIALIZE THE CONDEGA “F” SERIES CIGAR BRAND FOR UNFAIR COMPETITION.

The sentence prohibits the trade of CONDEGA SERIES “F” cigars displaying cigar bands similar to those used in the PARTAGÁS SERIES of Habanos, S.A.

Corporación Habanos, S.A., also known as Habanos S.A., a world leader in the commercialization of premium cigars, celebrates the decision of the Spanish Supreme Court ratifying the judgment of the Provincial Court of Valencia that recognized that GESINTA INVEST COMPANY, S.L. and LA CASA DEL TABACO S.L.U. had committed acts of unfair competition by presenting CONDEGA SERIES “F” cigars displaying cigar bands similar to those used in the PARTAGÁS SERIES of Habanos, S.A.

The decision also condemned the Companies to cease the commercialization of CONDEGA SERIES “F” cigars showing the infringing image. 

The decision also condemned the Companies to cease the commercialization of CONDEGA SERIES “F” cigars showing the infringing image.    Since the decade of the Thirties of the 20th century, the PARTAGÁS “Series” have differentiated the brand’s products, the best known of which are the “Serie C”, “Serie D” and the most recent “Serie E” vitolas. These “Series” exhibit a very characteristic cigar band and are always at the top of the sales rankings of Premium cigars worldwide.   The companies GESINTA INVEST COMPANY, S.L. and La Casa del Tabaco S.L.U. have been responsible for the commercialization in Spain of cigars of the CONDEGA brand, identified as “Serie F”. This product was offered to the consumer with a presentation almost identical to the one used by Habanos, S.A. for its PARTAGÁS brand “Series”.
